In June 2010 a House of Commons notice was sent to all MP’s in relation to a homeowners right to protect their property. The notice follows a pledge by the Conservatives to give homeowners greater protection when protecting their property following the Tony Martin and Munir Hussain cases.

11 out Of 20 Million Cases found Guilty

A little known fact is that in the 15 years prior to 2005, when the courts dealt with over 20 million cases, only 11 homeowners were found guilty of defending their property. That’s 11 out of 20 million – and you have to go some way to be found guilty as the law actually works in your favour. However, the legacy of the Tony Martin case (the Norfolk Farmer) and the more recent Munir Hussain case, make people believe that the law is stacked against them – and this is just not true.     – Addition – It should also be noted that Martin was refused parole in Jan 2003 and has, since his release, supported the BNP. Nice poster-boy for the rights of decent homeowners everywhere – I think not.

    I’ve got to chip in here. There was a miscarriage of justice in the Tony Martin case, this is true. Tony Martin was claimed to have gone about town, saying he was going to kill the burglars if he caught them and then acquired an illegal pump action shotgun. Evidence points to the fact that he also shot Barras in the back as he was fleeing. Everyone references ‘the farmer’ but not many actually have the facts and surrounding evidence.

    Based on this information, homeowners can tool up without fear of serious legal action and kill whomever they like with an obvious degree of premeditation. No doubt that the people he fired upon were scumbags, but the law is the law and judicial decisions such as on this case only fuel the confusion on what can and cannot be done to defend the home.
